To forget is but a basic human trait. However, what happens when you receive a letter from a collection agency asking for a debt so old you have completely forgotten about it? Debts such as these are called Zombie debts. Many people forget zombie debts completely. In fact companies to which these debts were owed give them up as a bad job themselves.
However, if a professional debt collector buys up your zombie debts from the company, that’s when the zombie nature comes out. Many businesses sell their old debts for a pittance, and many debt collectors buy them up and contact the debtor to recover the money.
If you do owe money, the debt collectors can legally take you to court. However, if the period of time that has elapsed from the last payment has not exceeded the statue of limitations, then they cannot do anything.
If you are being hounded by a debt collector for a zombie debt that you can not remember, make sure you remember the correct details. If by chance you either do not owe any debts, or have paid these off, you actually can take the debt collector to court.
According to the Fair Debt Collection Practices Act, you can send a letter to the debt collectors asking them to cease. From that point, debt collectors can legally contact the debtor only to say they are stopping, or are taking a specific action.
